Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Service. This Privacy Policy describes how the Company collects, uses, processes, and shares information related to you. This Privacy Policy applies to our Services (as such term is defined in the Terms of Service), including brandonn’s platform, websites (including subdomains), content, and other services that we may provide or offer to you from time to time as further described in the Terms of Service or detailed in an applicable purchase order accepted by us.

  1. WHAT INFORMATION DO WE COLLECT?

 

We divide the information we access and process into two categories: Non-Personal Information and Personal Information. In this section, we describe each of the two categories of information that we may process and the applicable circumstances under which such processing is performed.

 “Non-Personal Information” is unidentified and non-identifiable information pertaining to a user, which may be made available to us, or collected automatically via your use of the Services. Such Non-personal Information does not enable us to identify the person from whom it was collected and mainly consists of technical and aggregated usage information that is not linked to an identifiable individual, such as system data related to your operating system.

Personal Information” is information that identifies an individual or that may, with reasonable efforts or together with additional information we have access to, enable the identification of an individual, or may be of a private or sensitive nature relating to an identified or identifiable natural person. Identification of an individual also includes the association of such an individual with a persistent identifier such as a name, an identification number, persistent cookie identifier, etc.

Personal Information does not include information that has been de-identified, anonymized, or aggregated; provided that, such information can no longer be used to identify a specific natural person.

What categories and types of data do we collect? we collect and use the following categories and types of information:

  • Personal information you give us when you use our Services. Generally, this category refers to any information, data, or content you actively and voluntarily make available or provide us with access to enable and use our Services.
  • Information you voluntarily provide and/or make available to the Services for the purpose use of the Services, including without limitation: first and last name; email address; phone number; address, state, province, ZIP/postal code, city; business information; and your responses to our questionnaire.
  • The contents of your interaction with our customer support or sales teams, which may include information you enter in our “Contact Us” online form, “Beta registration” online form, or any similar input, or in an email correspondence to us.
  • Personal Information we collect automatically when you use our Services. We automatically collect through the Services the following categories of data: the device’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data. When you access the Services by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

The aforementioned categories are processed in a completely anonymized and statistical manner, where certain metrics and analytics are obtained through the use of third parties’ services.

If we combine Personal Data with Non-Personal Information, the combined data will be treated as Personal Information.

  • Personal information collected from other sources. We may also collect personal information concerning you from third parties who have assured us that they have obtained your consent for such provision of information or that you have freely and publicly provided.
  • Third-Party Social Media Service. The Company may allow you to create an account and log in to use the Services through certain third-party social media services (such as Google or Facebook) (“Third-Party Social Media Service”). If you decide to register through or otherwise grant us access to a Third-Party Social Media Service, we may collect Personal data that is already associated with your Third-Party Social Media Service’s account, such as your name, your email address, your activities, or your contact list associated with that account. You may also share additional information with the Company through your Third-Party Social Media Service account. If you choose to provide such information, during registration or otherwise, you permit the Company to use, share, and store it in a manner consistent with this Privacy Policy.
  • Candidates Information. We may publish open positions in the Company on our websites, and/or our LinkedIn, Facebook, or other social media pages. In connection with this opportunity, we collect information that is provided to us by the job candidates, when they apply to any of the open positions published, by name, email, or otherwise, and information we collect or generate following their application.
  1. STORING, TRANSFER AND RETENTION OF PERSONAL INFORMATION

Information regarding the Users will be maintained, processed, and stored by us and our authorized affiliates and service providers in the United States and Israel.

While the data protection laws in the above jurisdictions may be different than the laws of your residence or location, please know that we, our affiliates, and our service providers that store or process your personal information on our behalf are each committed to keeping it protected and secured, pursuant to this Privacy Policy and industry standards, regardless of any lesser legal requirements that may apply in their jurisdiction. Specifically, each of our Third Party Service Providers (as defined below) which store or process your Personal Information either: (i) assured us that they provide adequate safeguards to protect your rights to privacy; (ii) where applicable, hold and process such information on our behalf in jurisdictions which have been determined to ensure an adequate level protection by the EU Commission; (iii) perform such processing pursuant to your consent and acceptance of their privacy policy as further detailed in this Privacy Policy.

By providing your information, you expressly consent to the place of storage and transfer described above, including transfers outside of the jurisdiction in which the information was provided.

We retain the personal information we collect only for as long as needed in order to provide you with use of our Services in accordance with the terms of this Privacy Policy and to comply with applicable laws and regulations or otherwise as required for us to protect against claims by users for the relevant statutory of limitations period. We then either delete it from our systems or anonymize it without further notice to you. Notwithstanding the aforementioned, unless you notify us of your request to delete your account at brandonn, we may maintain your inactive account, including all data and reports therein, for a limited period, in order to allow you to reactivate the account to the Services if you choose to renew your activity at a later stage.

  1. HOW DO WE USE YOUR PERSONAL INFORMATION? LEGAL BASIS FOR USE

We collect, process, and use your information for the purposes described in this Privacy Policy, based at least on one of the following legal grounds:  

  • With your consent: We ask for your agreement to process your information for specific purposes, and you have the right to withdraw your consent at any time.
  • When Performing this Agreement: We collect and process your Personal Information in order to provide you with the Service, following your acceptance of this Privacy Policy; to maintain and improve our Services; to develop new services and features for our Users; and to personalize the Services in order for you to get a better user experience.
  • Legitimate interests: We process your information for our legitimate interests while applying appropriate safeguards that protect your privacy. Third-Party Services: We may share your information with a number of selected service providers, whose services and solutions complement, facilitate and enhance our Services and operations. Such third-party service providers may have access to, or process on our behalf Personal Information obtained through your use or access to the Services. These third parties include hosting, database, and server co-location services (e.g., AWS, Bubble.io, Airtable), data analytics services (e.g., Google Analytics, Hotjar) communications, marketing, and monitoring tools (e.g., HubSpot, SendGrid), , payment processing (e.g., Stripe), and our business, legal and financial advisors (collectively, “Third Party Service Providers”). Our third-party service providers act as our processors and may only process your Personal Information according to our instructions (which are made in accordance with the terms hereof). We remain responsible for any Personal Information processing done by such Third Parties Service Provider on our behalf not in accordance with the terms hereof, except for events outside of its reasonable control and except for such Third-Party Service Providers with whom you have a direct contractual relationship.

Law enforcement, legal proceedings, and as authorized by law: We may disclose or otherwise allow access to Personal Information pursuant to a legal requirement or request, such as a subpoena, search warrant, or court order, or in compliance with applicable laws and regulations. Such disclosure or access may occur with or without notice to you if we have a good faith belief that we are legally required to do so, or that disclosure is appropriate in connection with efforts to investigate, prevent, or take action regarding actual or suspected illegal activity, fraud, or other wrongdoing.

Protecting Rights and Safety: We may share your Personal Information with others, with or without notice to you, if we believe in good faith that this will help protect the rights, property, or personal safety of our Company, any of our Users, or any members of the general public.

Our Affiliated Companies: We may share Personal Information internally within our family of companies, whether current or future, for the purposes described in this Privacy Policy. In addition, should we or any of our affiliates undergo any change in control, including by means of merger, acquisition, or purchase of substantially all of its assets, your Personal Information may be shared with the parties involved in such an event. If we believe that such a change in control might materially affect your Personal Information then stored with us, we will notify you of this event and the choices you may have via e-mail and/or prominent notice on our website or Services.

For the removal of doubt, we may share your Personal Information in additional manners, pursuant to your explicit approval, or if we are legally obligated to do so. We process files, URLs, and other content you submit to our services (the “Submitted Data”), in order to provide you with our services, and the functionalities and features of the Services. We may use, process, edit, store, reproduce, and/or modify the Submitted Data, and may create derivative works therefrom, for the purpose of providing you with the Services and for researching, developing, enhancing, and improving our current and future products and services. To the extent you elect to upload Submitted Data to the Services, you are required to be the original owner of the Submitted Data or to have all necessary rights and permissions to the information in the Submitted Data.

In the event that your Submitted Data includes any information, that may be deemed as personal information under any applicable law, you hereby represent and warrant that you have obtained necessary or advisable consents required from any party and have otherwise the lawful basis upon which to share the personal information with brandonn and make all uses as contemplated under the Terms of Service and this Privacy Policy. You agree that in the event that you provide any third parties’ data and information, you have obtained all necessary consents to do so and that you shall be responsible for any conflict arising out of your submission of personal information of third parties involved in your Submitted Data.

We use in our Services cookies, pixel tags, and other Tracking Technologies, including ones offered by third-party service providers (collectively, the “Technologies”).
